Terms and conditions – ASHRAE Run 2020

1. Whilst every reasonable precaution will be taken by the Organizers to ensure participants' safety, participants shall partake in this event at their own risks. The Organizers, their sponsors and their appointed officials shall not be liable for any death or injury, loss or damage, suffered or otherwise and howsoever arising. The Participant upon registration hereby waived his/her rights to take any legal action whether or not contractual or negligence or under any laws or enactment against the Organizers for any loss, injury and damage pertaining to their participation in ASHRAE Run 2020.
2. The Organizers reserve the right to remove any participant deemed physically incapable of continuing with the race to prevent him/her from causing greater harm and injury to him/ her.
3. The Organizers reserve the right to delay or cancel the commencement of the race in the event of inclement weather. Should the inclement weather persist after delay, the Organizers reserve the right to cancel the race at their discretion without any refund.
4. The Organizers shall not be responsible for any disputes arising from incomplete entry details.
5. Officials reserve the right to prevent a participant&'s continuation in the race should they fail to comply with the rules and regulations.
6. The Organizers reserve the right to limit, accept or reject any entries without prior notice and reasons.
7. The Organizers reserve the right to amend the Rules and Regulations without giving prior notice
   or any reasons thereof.
8. The Organizers reserve the right to provide winners with the attire to be worn on the winner's podium. Winners will have to wear the given attire; failure to do so may result in disqualification.
9. If the weather does not permit (heavy rain / haze) the Organizers have the right to cancel the event, and/ or to give the participants entitlement but without any refund.
10. Race entry is non-transferable. Those who are found running with an unauthorized race number from the Organizer will be disqualified.
11. The Organizers reserve the right to use any photographs (including those of participants), motion pictures, recordings, or any other record of this event for any legitimate purpose, including commercial advertising.
12. Participants must run on the designated path for the entire race. Failure to do so will result in disqualification.
13. It is compulsory for the participants to display their race number at all times during the race. Failure to comply will result in the participants' disqualification from the race.
14. All participants are encouraged to wear the ASHRAE Run 2020 event t-shirt during the race.
15. Change in event t-shirt sizes during collection of the Race Kit Pack is STRICTLY PROHIBITED. Participants must adhere to the race event t-shirt sizes that they have registered for.
16. Participants taking part are required to keep to the left side of the lane so as not to cause obstruction to other participants.
17. No pets and/or any form of wheel-run objects of transport e.g. inline skates, prams, push cars, shoes with built-in or attached rollers are allowed on the course other than official race and medical vehicles.
18. All entries are based on a first-come first-serve basis unless otherwise stated.
19. Participants below the age of 18 are required to seek parental/ guardian's consent and fill up the relevant indemnity form (Please click to download the form) as deemed necessary by the Organizers upon registration. The MINIMUM AGE for participation in ASHRAE Run 2020 is 6 YEARS OLD. Children below the age of 13 MUST be accompanied by a parent/guardian at all times. Failing to do so, the Organizers reserve the right to refuse entry to any applicant.
20. Once the registration is completed and payment has been made, entry fees for those who for whatever reason(s) do not take part in the run are NON-TRANSFERABLE, NON-REFUNDABLE AND NON-DEFERRABLE.
21. Upon confirmation of participation, change of category or other details will not be entertained.
22. The Organizers reserve the right to close entries before the deadline without any prior notice and/ or when the quota of a race is full.
23. The race results are final and indisputable.
24. To collect the Race Kit Pack, the participant must show his/her IC, passport or confirmation slip (hard copy or soft copy). The participant is allowed to send a representative to collect the Race Kit Pack on his/her behalf. The representative must present the participant’s confirmation slip. (Hard copy or soft copy). The Organizers reserve the right to not give away the Race Kit Pack if the participant fails to do so.
25. Completion of the registration form is an indication of the participant's agreement to abide by the rules and regulations of the ASHRAE Run 2020.

Waiver Declaration

ASHRAE RUN 2020
This is an important document as it affects your legal rights. By ticking the checkbox upon submission of your online registration of ASHRAE Run 2020, you agree to all the terms stated in this document. You should read it carefully and understand it before you submit your ASHRAE Run 2020 registration.

It is a condition of your entry to and your participation in the ASHRAE RUN 2020 that you read this document.

1. I acknowledge that:
   (a) Participation in ASHRAE RUN 2020 is a test of a person’s physical and mental health and carries the potential for death, personal injury, and/or property loss.
   (b) I certify that I am physically fit and have no pre-existing medical conditions, and have sufficiently trained to participate and have not been advised against participation in the sport/s by a qualified health professional.
2. In consideration of being permitted to participate in either ASHRAE RUN 2020, I acknowledge, agree and certify the following:
   (a) I ACKNOWLEDGE that there may be people, animals, vehicles, objects or materials on or around the course route, which may constitute hazards. I assume all the risks associated with running and walking, and all other risks associated with participating in the event/s.
   This includes but is not limited to falls, collisions, contact or crashes with other participants, Race Officials, Volunteers, Spectators, course markers or other obstacles or hazards; the effects of weather including rain, heat or humidity and lightning strikes; defects in my personal equipment or equipment provided by Race Organisers; the conditions of the course including roads and footpaths; hazards that may be posed by the presence of spectators or people involved in ASHRAE RUN 2020. All these risks are known to and appreciated by me and I accept them of my own free will.
   (b) I FURTHER ACKNOWLEDGE the risk that the Race Organisers or individuals participating in controlling officiating or involved in or contributing to the conduct of or organising or watching ASHRAE RUN 2020 may act negligently which may result in harm or injury to my property or me. These risks are also known and appreciated by me and I accept them of own free will.
   (c) I CONSENT to the provision to me of first aid, emergency or other medical treatment for the purposes of treating or relieving injuries or physical harm that I may suffer as a consequence of participation in the ASHRAE RUN 2020. I authorise licensed medical practitioners, hospital or other medical or health care facilities to perform all medical procedures, which they may consider medically advisable to attempt to treat or relieve such injuries, including but not limited to the administration of anesthesia and provision of blood transfusions. I realise and appreciate there is a possibility of complication and unforeseen consequences in any medical treatment which I may receive and I assume that risk. I acknowledge that no warranty is made as to the results of any medical treatment.
   (d) I WAIVE, RELEASE, AND DISCHARGE the Race Organisers and any medical staff or volunteers and any individuals participating in, controlling, officiating, involved in or contributing to the conduct or organizing or watching the above race/s from any and all claims, losses or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft or damage or any kind, including economic loss, which may however exist or arise in the future arise out of or relate to my participation in or my travelling to and from Universiti Malaya ASHRAE RUN 2020, or arising out of the risks I have assumed in participating in the race/s as set out above whether or not caused by negligence of any person.
   (e) I AGREE not to sue or claim against any of the Race Organisers for any of the claims, losses or liabilities that I have waived, released or discharged in this document.
   (f) I INDEMNIFY AND HOLD HARMLESS the Race Organisers from any and all claims made by me or liabilities assessed against the Race Organisers as a result of:
   (i) My actions or inaction;
   (ii) The actions, inaction or negligence or others including the Race Organisers;
   (iii) The conditions of the facilities, equipment or areas where the ASHRAE RUN 2020 events or other associated activities are being conducted;
   (iv) Implementation of the Competition Rules; or
   (v) Any other cause arising from an occurrence related to the above races; and
   (g) By signing this document, I bind myself, my executors, administrators, heirs, next of kin, successors and assigns and any other person who may claim or sue on my behalf.
   (h) I AGREE to abide by the Competition Rules adopted by ASHRAE RUN 2020 and I acknowledge that my entry to either and/or both races may be revoked or suspended for violation of the Competition Rules.
3. For the purposes of this document, “Race Organisers” means ASHRAE Malaysia Chapter (MASHRAE), UM ASHRAE Student Branch, The Engineering Society of University of Malaya (PKUM), University of Malaya, the race officials, medical staff and volunteers, and all officers, directors, servants, employees, contractors, representatives and agents of any of these entities.
